Footpath off Haunders lane changing to 'restricted byway'

8th of April, 2022

The attached notices are in relation to a local footpath being upgraded to a restricted byway The path in question is:

Restricted Byway from the junction with Haunders Lane in a generally northerly direction along an unsurfaced farm track to the junction with a public footpath recorded as 7-8-FP 3 and then along the route of the footpath to pass through Marsh Farm and then continuing along the farm access road (still recorded as 7-8-FP3) to Hannings Farm and the junction with Haunders Lane. - In layman's terms this means what was once just a footpath will be opened up to bikes and horses and other non mechanical vehicles. If you have any objections to the LCC order changing its use then the details of how to object are below.

WILDLIFE AND COUNTRYSIDE ACT 1981
DEFINITIVE MAP MODIFICATION ORDER
EXPLANATORY STATEMENT
THIS STATEMENT DOES NOT FORM PART OF THE ORDER
Public footpaths, bridleways, restricted byways and byways open to all traffic are recorded on definitive maps and statements. These maps and statements provide conclusive evidence of the existence of public rights. Lancashire County Council is responsible for the definitive map and statement and has a duty to modify them when evidence suggests that they are inaccurate or incomplete. This is achieved by means of modification orders made under section 53 of the Wildlife and Countryside Act 1981.
The council has made such an Order to record a Restricted Byway from the junction with Haunders Lane in a generally northerly direction along an unsurfaced farm track to the junction with a public footpath recorded as 7-8-FP 3 and then along the route of the footpath to pass through Marsh Farm and then continuing along the farm access road (still recorded as 7-8-FP3) to Hannings Farm and the junction with Haunders Lane.
The evidence on which the council has made the Order is the historic map and documentary evidence submitted by the applicant and examined in subsequent investigations dating from the 1820s to the present day, along with aerial and ground photographs.
This evidence may be consulted free of charge by contacting; Lancashire County Council, Legal Services Group, PO Box 78, County Hall, Preston, PR1 8XJ or emailing [email protected].
Representations and objections relating to the Order must be made in writing by 19 May 2022 to [email protected] or to Simon Moore, Lancashire County Council, PO Box 78, County Hall, Preston, PR1 8XJ (REF: LSG4/888.2183/SM18)
To be relevant, representations or objections should relate to the existence or status of rights of way; other issues, such as privacy, security or amenity are unlikely to be relevant. If you want to discuss a representation or objection to this Order, contact Simon Moore at the address above or by phone on 01772 531280 or e-mail [email protected]
This Order does not come into effect until confirmed. If there are no representations and objections to the Order, or those made are withdrawn, the council can confirm the Order, and the definitive map and statement will be modified. If there are any representations and objections which are not withdrawn, the council must send the Order and representations and objections to the Planning Inspectorate who will appoint an independent inspector to consider the Order and the representations and objections. The Inspectorate will normally hold a hearing or an inquiry, but it could determine the Order through written representations. The inspector may confirm the Order, with or without modifications, or may decide that the Order should not be confirmed.
